A Notary Public is a state-appointed official who serves as an impartial witness to the signing of important documents. Notaries are required to follow statutory rules and are expected to act without significant personal discretion. They cannot give legal advice or draft legal documents.
A notary public’s key aspects include: verifying the identity of a signer(s), acting as an impartial witness to document signing, administering oaths and affirmations, maintaining a record of notarizations, using a seal of office, and ensuring the signer(s) are signing freely and knowingly, all to prevent fraud and authenticate legal documents.
A Notary Public certifies the proper execution of many of the life-changing documents of private citizens — whether those transactions convey real estate, grant powers of attorney, establish a prenuptial agreement, or perform the multitude of other activities that enable our civil society to function.
